Do you want to rent out your vacation home? Then it is important to draw up a clear rental contract. This establishes all rights and obligations in a legally valid document. This way the tenants and landlords know where they stand. We list the most important information for drawing up a rental contract for your vacation home.
What should be in the rental contract for a vacation home?
The rental contract sets out all the agreements between the tenant and the landlord. This should always be in it:
- Who is the tenant?
- Who is the landlord?
- What is the duration of the lease (start and end date)? This is important because there are different notice periods for tenant and landlord.
- Description of the leased property: what is the condition of the vacation home and are there any defects?
- How can the lease be terminated?
- What is the total rental amount?
- How much is the deposit?

Rental protection: not for vacation homes
In Belgium and the Netherlands, tenants enjoy rental protection. This means that you cannot simply be evicted by the landlord. It is different when renting or leasing a vacation home. If the rental agreement for the vacation home is temporary, the tenant is not entitled to rent protection. The rental agreement expires when the specific rental period has expired. AIs the rental agreement is not of short duration, you as a tenant can claim rent protection. Since vacation homes are almost always rented out for a short period of time, the rent protection rule often does not apply here.

Lease agreement for a vacation home for a longer period
Do you want to rent out your vacation home for a longer period? Then it is important to record this clearly in the rental agreement. Keep in mind that the tenant is entitled to rent protection when renting for a longer period. Be sure to read up on your rights and obligations as a landlord before renting out your vacation home for a longer period.
Points of attention in a rental contract
If you draw up a lease for a temporary rental, it is important to state the temporary nature correctly. If you don’t do this, the tenant can claim rent protection after the lease is terminated. This is annoying to you as a landlord. Besides a written lease, an oral lease is also legally valid, by the way. Just make sure a witness is present so you can prove this agreement.
